Under the Texas Dram Shop Act, a provision in the state’s Alcoholic Beverage Code, licensed alcohol vendors can be liable for injuries caused by their customer if the vendor sold alcohol to:

  • A minor under the age of 18

  • A customer of any age clearly intoxicated enough to pose an obvious threat to their own safety or the safety of others.

In either case, a plaintiff must prove that the driver’s intoxication was a cause of the accident.


Additionally, under Texas law a host over 21 may be held liable for injury caused by a minor under the age of 18 whom they either supplied with alcohol or knowingly allowed to consume alcohol on their property. This is true whether or not the minor was obviously intoxicated. The statute of limitations of two years within the date of the injury also applies to these claims.
